By purchasing this course, you hereby certify that you are the parent or legal guardian of an athlete who is age 9 or older or an athlete who is age 18 or older. You hereby agree that to access the course, you must join the private community, the Block Breakers Circle and agree to the Community Behavior Section outlined below. Membership includes athlete online access for the purposes of participation in the Community through the Athlete’s Circle. Parents may also join the Parent Section of the online community. Once inside, complete the WELCOME CHECKLIST which will walk you through navigating the portal.

You hereby agree not to share login details with anyone else, including the link to join the portal. In addition, you agree not share the workbook or any other course materials with anyone other than the athlete for whom it is purchased. All rights to the materials are reserved. Copying or distribution without the express written consent of Mandy Patterson Coaching LLC is a violation of this Agreement and protection of the rights to the materials may be enforced by legal action, including, without limitation, immediate termination of membership without refund.

Mental Performance Coaching Overview

Mandy of Mandy Patterson Coaching LLC (MPC) is a certified Mental Game Coaching Professional through the MGCP certification program. MPC is not a medical program and does not perform any services that deal with, diagnose or treat medical, psychological, or physiological disorders or issues.

Payments

Programs may be paid in full at registration or in installments by using the checkout option selected. If you’ve chosen the installments option, your payments will be automatically charged to the card on file. You will receive a confirmation by email after your credit card is successfully debited.

If you have chosen to make installment payments, please note that you are responsible for completing your remaining payments. You will still owe the remainder of your payments regardless of whether you complete the full course materials or not.

Scope of Mental Game Coaching

You understand that the scope of Mandy Patterson Coaching’s mental performance coaching is defined as instruction and education for the purposes of performance enhancement in sports or careers. As such, you understand that you are entering into an educational program to improve mental skills for performance enhancement only.

There is no implied or expressed guarantee or warrantee that services provided by MPC will result in improved performance or earnings. The results you obtain from MPC coaching vary widely depending on but not limited to the athlete’s participation, effort, motivation level, cooperation, training during and in addition to MPC sessions and ability to implement and make changes; or other aspects over which neither Party has control.

You further understand that MPC’s mental performance and mental game coaching is not a medical treatment, psychotherapy, psychological therapy, or psychoanalysis for the diagnosis, rehabilitation, or treatment of psychiatric problems. MPC does not utilize medical or psychological professions and does not recommend or prescribe any form of medication.

Course Materials

As part of the A-Game Athlete TM Course you will receive access to the A-Game Athlete TM workbook. You may purchase a physical copy at checkout or by emailing us at support@mgpcoach.com or download the workbook from the portal. The workbook is for your personal use only. You hereby agree that you will not copy, share or otherwise distribute the workbook to any third party.

YOU MAY CANCEL THIS AGREEMENT AT ANY TIME PRIOR TO MIDNIGHT OF THE FOURTEENTH CALENDAR DAY AFTER THE DATE OF PURCHASE. To cancel this Agreement, email the MPC Support Team at support@mgpcoach.com with the subject “Cancellation Request” and a signed and dated Notice of Cancellation. The notice must state that you are canceling the Agreement, or words of similar effect. Cancellation refunds do not include the cost of materials.

Non-Disparagement

The Parties hereby agree that the Parties, without limitation, are prohibited from making any statements, in any medium, written or verbal, or cause or encourage others to make any statements, written or verbal, which defame, disparage, or in any way criticize the other Party or the other Party’s businesses.  This does not, in any way, restrict or impede either Party from exercising protected rights to the extent that such rights cannot be waived by Agreement or from complying with any applicable law or regulation or a valid order of a court of competent jurisdiction or an authorized government agency, provided that such compliance does not exceed that required by the law, regulation, or order. Either Party shall provide written notice of any such order to the other Party.

Dispute Resolution

In the event of a claim or dispute, you will first speak with us in good faith. You must send a written description of your claim by email. You agree that you and MPC will be resolved by mandatory binding individual arbitration, and you waive any right to participate in a class- action lawsuit or class-wide Arbitration, consolidation, court proceeding, or jury trial.

Limitation of Liability

In no event will our (company and its affiliates', contractors', Employees', agents', attorneys', or third-party partners', licensees, licensors', or Suppliers') total liability to you for all damages, losses, claims, and causes of action arising out of or relating to this terms, or your accessing or using the site, program, Platform, service, or reference site / program, or your interaction with other users (whether in contract, tort including negligence, warranty, or otherwise), exceed the amount paid by you, if any, for accessing or using any program, site, platform, or Service, during the twelve (12) months immediately preceding the date of the claim or One hundred dollars ($100.00), whichever is greater. The liabilities limited by this section Include, without limitation, liability for gross and ordinary negligence. These Limitations of damages also apply with respect to damages incurred by you by reason of any use of any site, platform, content, program, products or services licensed, Sold, or provided on any platform, reference site / program or otherwise by third parties and received through or advertised on any site, program, platform, service, or content, or received through any reference site / program.

Arbitration; Equitable Relief

This Agreement shall be governed in all respects by the law of the State of Georgia and the United States of America. In the event of a legal dispute or claim between the Parties arising out of or in connection with this Agreement, any action shall take place exclusively in Dawson County, GA, and in such instance, the prevailing Party shall be entitled to recover attorney fees and costs incurred at all trial levels.

(a)       Arbitration. Any dispute or controversy arising out of, relating to, or concerning the interpretation, construction, performance, or breach of this Agreement will be governed by state law and settled by Arbitration to be held in Dawson County, Georgia in accordance with the then-effective rules of the American Arbitration Association. The arbitrator may grant injunctions or other relief in that dispute or controversy. The decision of the arbitrator will be final, conclusive, and binding on the Parties to the Arbitration.  Judgment may be entered on the arbitrator’s decision in any court having jurisdiction. The Parties shall each pay one-half of the costs and expenses of that Arbitration, and each Party shall separately pay counsel fees and expenses.

This Arbitration clause constitutes a waiver of the Operator’s right to a jury trial and relates to the resolution of all disputes relating to all aspects of the Business relationship .

Claims and remedies sought as part of a class action, private attorney general or other representative action are hereby voluntarily waived and barred by your participation in the Program, and both Parties agree that relief may only be granted on an individual (non-class, non-representative) basis. This Agreement shall be governed by and solely construed in accordance with the laws of the State of Georgia. The Parties agree that any proceeding arising out of, or relating in any manner whatsoever to, this Agreement shall be brought in Dawson County, Georgia Each Party waives any objection, and irrevocably accepts and submits to the jurisdiction and venue of the aforementioned courts. The Parties agree to pay their own fees, costs and expenses including those for counsel, experts, discovery, and witnesses.

Severability

If any portion of this section or Agreement is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this section, or the Agreement, each of which shall be enforceable to the fullest extent possible, regardless of such invalidity.

Jurisdiction

This Agreement is governed by the laws of the State of Georgia. You agree that by purchasing this program, you are providing your digital signature, which is equivalent to a handwritten signature as provided in The Federal E-Sign Act.

Community Behavior
We require all athletes in our programs to behave in a respectful manner towards us and towards other athletes that does not cause disruption to the programs, including not criticizing other participants in the sessions or community threads and complying with our house rules and policies. This is absolutely critical to maintaining a positive, constructive, and productive space.

1. If you do not comply with the above, we have the discretion to terminate your participation and this Agreement immediately. Depending on the gravity of the behavior, it is at MPC’s discretion  to return any payments to you.
2. It is critical that clients are able to feel they can talk about issues in a safe environment. Information shared by others during the group sessions is confidential and you agree not to divulge that information to people who were not in the sessions themselves or to third parties (including on social media). Furthermore, you agree not to discuss information shared during sessions to people who were in the sessions outside of the virtual container provided by MPC.

Student/Client Confidentiality Policy

Mandy Patterson Coaching LLC and Mandy Patterson respect the rights of students’ privacy and confidentiality. In certain cases, it becomes beneficial for MPC to discuss the student’s case with another person such as the parent, coach or trainer. MPC agrees to maintain student/coach confidentiality and not discuss details of student’s case with other persons (except for parents of the athlete when the athlete is under 18 years of age) unless MPC obtains written permission from the athlete prior to discussing details of a student’s case.

Intellectual Property Rights

MPC retains all ownership and intellectual property rights to the program content and materials provided to you throughout the program. The content and materials are being provided to you for your use and the use of your child(s) only. You are not allowed or authorized to share, copy, sell, post, distribute, reproduce, duplicate, trade, resell, exploit, or otherwise disseminate any portion of the program or program materials, electronically or otherwise.

Risk of Injury

As with any sports performance coaching program, there is a risk of injury (physically and mentally) to athletes.  MPC is not responsible for physically or mental injury, including stress, to the athlete as a result of the mental coaching process. It is the responsibility of the client to report any concerns or issues that are identified during the coaching process.

Waiver

I agree to save and hold harmless, indemnify and defend MPC, Mandy Patterson, their employees, affiliates, directors, successors, agents, heirs and assigns from all liability, loss, cost, claim or damage whatsoever, including death or damage to person or property, which may be imposed upon said client because of any defect in or lack of such capacity to so act or caused or alleged to be caused in whole or in part by the negligence of the client. I have read the above waiver/release and understand that I have given up substantial rights by signing this release and sign below voluntarily.

By purchasing this coaching program, you consent that you have read, understand, and accept the above coaching terms and conditions.
